Glad to see this team has taken on the gaint!!!
I am a beneficiary of the GC process , my husband being the primary applicant.
Applied for 485 in 2002.So now i am in the "pending immigrant" category.
I attend a top Medical school and expect to be offered a Leadership TrainingGrant under the Bush's no child left behind program to serve US citizen/residents children/infants.
As this package comes with a payback ie need to serve the country/citizens anywhere in the world for 2 yrs post graduation i need to evaluate my options. I take this grant and move away without payback it will be fraud or i will have to payback 80K!!!( tuition etc)
With the GC in limbo and not sure what will happen I will be forced to reject this offer!! I will get full scholarship from elsewhere so i aint worried about it.. but this country has missed out on my services due to the delay in GC.
Currently i am assigned in the Veterans Affairs and treat soldiers from Iraq and other places, also I am expecting to take up a position in VA post graduation (ie only if I get GC!!/Citizenship.. which could i could have if the GC were to be processed in 1-1/5 yrs and post that 5 yrs would be the time of my graduation) Again this country is loosing.

I would have to be an absolute moron to contribute to IV, and to work for it, if at the end it costs me more in getting a green card.
So, either you think that IV-ers from ROW are morons. Or you want them to quit, and turn this organization into an Indians-only group.
Its as simple as that. You can quote all the laws in the universe, and come up with all the fancy logic that you want. But what I have said above is what it all boils down to.
No one here takes advantage of any group. We are talking here is what law says and how it is implemented by various agencies. The problem is there is doubt that DOS has not understood the law. No one is against ROW and loves India and China. US immigration simply based on preference catagories. For example, wife of U.S citzen will be given first preference in immigration (FB1) compare to brothers and sisters of US permanent residents (FB4or5). This is the law.
Similar thing in employment catagories too. Before 2000, there is a verical spill over of EB visas. Becase of this, a high skilled workers from India/China has to wait more compare to low skilled workers from ROW. This practice will not put US in technological edge. Thats why AC21 law implemented.
After 2000, congress removed country quota in all EB catagoires. The simple reason is to make US competiveness in 21st century. The intend is simple.
The simple meaning of AC21 law is, for example, let us assume following hypothitical situation. There are 40,000 noble prize winners from Mexico. All of them applying EB1 visas in a FY. In same FY, no one from other countries applied EB1 visa. As per AC21 rule, entire 40,000 visas (100%) goes to Mexico in EB1 irrsepective of how EB2 or EB3 or FE catagories are retrogressed or howmany mexians in EB/FB are waiting. This is what congress intend to promote high skilled immigrants to USA. This is what american competivness in 21 century. The intent here is noble prize winners should not wait even if they are from oversubscribed countries like mexico.
If you read word by word of AC21 rule ..you will understand what I am saying.

If he was approved this month, it must have been based on the August Visa bulletin. If so the priority date for EB-2 is not current for this guy (per bulletin it is 01OCT03). Also his 485 application date is eight months away from the current processing date.

1. I am not anti immigration, I am anti illegal immigration. You may not see a difference between the two but I assure you there is one. And no one can make me leave 'in a wink". Why? Because I am not illegal.
2. You are wrong in beliveing that majority of Americans want some amnesty for illegals. They dont, although some policticians have clearly made political calculations and believe that the demography of illegal immigrants will favour them in the polls.
3. You may believe that you are a temporary visitor here. This is home for me.
4. I just side with what I believe is right. That may sound being righteous to you.
5. Your sympathy is misguided again when directed towards condemend criminals. It should be directed towards there victims. I am curious, will you have sympathy for Kasab if he is hanged?

USCIS do have some checks and balances for the subst labor cases, so its not a staright approvals for the lab subst cases. their might be a possibility few lucky ones get off the hook, but overall USCIS can weed out the dubious/fraudulent employer petitions.
Sub labor is not the only reason guys, its just the country cap which is limiting india EB-3 and EB-2. Most of the H1Bs like us coming to us ends up applying for GC, now look at the number of H1Bs coming each year from india and the total number of GCs available for india. Their is a huge gap in these numbers, so unless they remove the country cap or recaptured unused VISA numbers from the past years, we dont see any relief.
Please donate to IV and help lobbying for the admin fixes or the laws which going to help us in the long run.

USCIS has just released their tally of cap filings as of 04/04/2007, Wednesday. In two days (04/02 and 04/03), they received 133,000 unique pieces of mail containing H-1B petitions, which turned out to be lower than 150,000 which they had initially reported. They reached the updated number following a physical count of the mail. Each piece of mail may contain more than one H-1B petition and it will take USCIS a substantial amount of time to open and sort through that volume of mail. It is a good news in a way that at the end, the total may turn out to be less than guestimate in the community and the rate of odds for winning in the lottery may be much more promising than the one initially anticipated in the rumors.
As of Wednesday, total they sorted out and each type of cases identified were as follows:
Total Sorted Out: 32,755
General cap cases: 28,052
U.S. Master or higher degree cases: 4,703
The USCIS promises to update report from time time as they continue to sort out the remaining packages.
It is surprising that the U.S. Master or higher degree cases are more or less higher than expected.

If it were for some of the antiimmigrant folks, my friend you (sugaur) wouldn't be here a day longer. you would be "out" in a wink from this country. so dont consider yourself too supportive of anti-immigration. Even citizens are favoring resolving the ilegal immigration crisis by granting some legality to those who are here ilegally. Thanks a lot to all members for being with us in this struggle. We have tasted our first big success this year. Credit goes to each and every IV member. We were all affected by the visa bulletin fiasco and this is our victory. This is a victory for all our members and we must rejoice.
IV had worked very hard and had been pushing for this in the background. Our flower campaign, rally and other advocacy efforts all came together and helped us at a crunch time. We thank members that sent flowers and also walked in the San Jose heat for 4 hours. All that really shows our commitment to this cause.

This thread brings up a good point - of labor reuse & misuse in yester-years.
Incidentally there are many who have never seen a glimpse of what is inside their labor certification as the employer & their lawyer still refuses to share it with the candidate. And i am not talking of the oft-bashed consulting companies.
For the candidate - who continues to pursue the American dream, it is:
1) Not Transparent
2) Subjugation to the whim of Employer / Lawyer
3) Non compliant to a common code implying a non level field of play
Thereby Unfair.
In my humble opinion - should be part of the core argument we have against the system.

Its pity that MOST CRITICAL issue we are facing at present - AC21 Denial issue, is having only 77 mails but everyone is jumping gossipping. Come out of this and show a unity to real problems.

I am seriously worried about the bill S.1035 which is going to intoduced in the senate. Does this bill have any impact on the Masters students up here? I will be graduating this summer.
