Hi All,
I have my EB2 485 pending (since July, 2007). I have EAD based on that filing. I am also on H1B - so I am not using EAD. But my wife intends to use EAD (based on our current EB2 based 485 filing) from coming August.
In the meanwhile I have got my EB1 140 approved. My question is if we file for 485 based on EB1 petition, do we lose our current EAD till a new EAD is issued under new filing? Are there ways to ensure that my wife continues with her employment and I move ahead with 485 filing?

Explore interfiling... no personal experience ... but the idea is that they use the same I-485 but interchange the underlying I-140. Seems like there is no special form for this but to just write to USCIS with evidence for the new approved EB1 I-140.

I was July 2nd I-485 Filer (for me and my wife), received only my Receipt notice in September. When enquired about my wifes RN in September, USCIS claimed there was no information in the database.
My lawyer sent a letter to USCIS and they personally responded along with sending the RN for her 2 weeks ago.

I agree the right way for Company B was to apply for concurrent H1-B that will allow you to work part time for Company B while working full time with Company A.

This move in visa number is dramatic and not to mention scary. It also has the hint that dates will retrogress in FY2008, there is no way that everyone will be processed by the end of this year.
If I were you I would keep the earliest priority date and not worry about the category its in, but then its just me and my choice :). You can judge yourself.

You can apply for an MTR, and if it is approved, you are safe. If not, you will be out of status from the day your petition was denied.
You can apply for H1 with another employer and have it premium processed.

My received date is Aug 15, 2007.
I looked at the new I485 instructions and the fee now is $985.00.
So i think I payed under the old structure. I am going to include the fee for both of them.

Just reply on a separate piece of paper explaining the relevant details, as asked. Thats what we did. Can't remember details now but things like "I-485 was applied in so and so month as a dependent in so and so month." Some information about the primary, relation to primary and such. You can add the A number (we didn't have it at that time).

It's hard to answer your question without more details, such as your current status. Company B can definitely file a new H-1B for you. Your current status will dictate whether you "need" to tell them about the earlier filing. However, having a prior petition filed might not have any negative impact, so you probably don't need to be nervous about telling Co. B.

Hello
I have received so many different responses regarding the shots required for over 65s. Our local health department, the INS Doctor and the INS all seem to be providing different information, I'm hoping someone can clarify.
The civil surgeon provided us with a list of shots, basically it contained all the shots including those that I thought were just for children. We went to a public health nurse today who gave us TDP and Varicella shots. Are the MMR, flu and pneumococcal shots required by the INS?
The INS approved Doctor wanted $600 per person for all of the shots. The exam and blood test were $120. We've decided to go to a private Doctor and the local health department for the shots instead of paying the $600. I'm hoping someone can clarify what is needed so that we avoid paying for shots that are not needed.

To be honest, none of the immigrationvoice members are over 65 years or know someone who is processing the green card through employment based category. Try googling.... thats the best bet.

Can somebody guide me with the PR process for Canada,
I am Computer Engineer with H1, and i need the requirements for Canada PR,
eg , Do i need TOEFL or IELTS ? Do i need a Job Offer there? My Dads cousin brother is in Toronto, Do i get ant benefits (as it would be tough to prove the relationship)
Any help would be appreciated..

DS 157 is required based on age of the applicant ... your dad may not need but your mom need it ... pls check the vfs site for age range for DS 157 ...

Shameful, yes, but inevitable, because corruption feeds on desperation. Greg Siskind (following the original link) is not sure if there is a trend here, but it seems to me in recent years there is a perceptible shift in the occupation of these fraudsters, moving upscale from small-time crooks to the ringmasters who are supposed to help enforce immigration laws.
