I talked to my lawyer today about what he thought about this new development and he indicated that there might a court challenge to this new rule. Now from a lawyer's and employer's point of view, I can understand their frustration and they certainly have the money to drag this thing in the court for a while but the question is will they? And if they decided to go to court, will the new rule be halted until a decision is made by the court? He indicated that the least the lawyer's and employer's might accept is to exclude the existing approved labors from being affected by this new rule.
Let's all hope that they don't succeed; otherwise this new rule won't help us as much as it could.

I am sure this is going to happen within this week or next week.
1. They are going to take the revised visa bulletin and flip flop out from the website.
2. They will accept application as Visa Bulletin said on Jun 9th.
3. Because of this mess, they are going to give grace period till Aug 2007 for filing.
And in addition they will say that they will keep it in the backlog and when Visa number gets available they will process.

An important bill was introduced in the house today that forces the FBI to end all namecheck backlogs. This is a very short bill and it has just one provision - to end namecheck backlogs. This is exacly the kind of bill we were looking for.
This is different from the bill that was passed in Senate recently.
The important thing for all of us:
WRITE TO YOUR REPRESENTATIVE AND ASK HIM/HER TO SUPPORT THIS BILL.
Unless you write, this bill is not going to pass - please do so immediately.

(b) Elements of Plan- The plan shall include the following elements:
(1) Necessary improvements to computer systems so that all records may be transmitted, maintained, and checked electronically, and whether it is possible to centralize this information in a single searchable database.
(2) How the FBI will improve communications with USCIS to ensure the maximum efficiency in processing name check requests from that agency.
(3) Security upgrades in transferring information between the FBI and USCIS to ensure the privacy of any individual receiving a name check.
(4) Long-term fixes that will prevent any future backlog, including a risk management analysis of changes that can be made to streamline the process and policies for obtaining FBI name checks in connection with applications and petitions for immigration benefits.
(5) An estimate of the funding required to complete the operation by the required date along with an estimate of any possible fee increases.
(6) A study regarding the best practices in assessing the level of risk presented by applicants. The study will determine whether the current risk assessment process should be modified.
(7) A report of the number of applications and petitions that remain pending at USCIS more than 6 months after the name check results have been returned from the FBI to USCIS.
(c) Effect of Backlog On and After 18 Months of the Date of Enactment of This Act- Beginning 18 months after the date of the enactment of this Act, the National Name Check Program is not authorized to have any file in backlog status. After that date, any name check request from USCIS held in the possession of the National Name Check Program for longer than 6 months--
(1) will be referred to the Secretary of Homeland Security, who shall adjudicate interim benefits in connection with the application with which the FBI name check was requested, unless the Secretary certifies there is reasonable cause to suspect that the applicant poses a threat to national security, otherwise poses a threat to the United States, or has broken United States immigration law; and
(2) the name check fee shall be fully refunded.

Thanks for the additional information. In case 1 - can the applicant still retain the priority date if s/he wants to start a new GC process? In other words, does 6 year expiration have any effect on retaining PD?
From what I have gathered so far, it appears that it's a misconception that a lot of people have who feel it's safer to stay on H1. It doesn't sound like EAD is as bad as I had once initially thought..
As far as I know, one retains the PD for life once I-140 is approved; unless CIS revokes I-140 due to fraud or min-interpretation. Otherwise PD is yours forever, across the category (eb-1, 2 or 3).

Following is my case....please help me make a decision on whether to see this through or not submit passport and just travel back on AP...
Chennai consulate H1. (transfer from F1-OPT-H1).
January 2nd - date of visa interview. Asked for additional info - 221g because I have a Phd in biology
January 6th - submitted additional information. research. publications etc.
February 1st (friday afternoon)- status updated to 'send passport' on chennai consulate website.
My concerns are -
1. How long does it take VFS to return passport, if I submit passport on Monday, February 4th?
2. Would I still have to go through the PIMS verification or should I assume the consulate has already done this because they have asked me to submit passport?
Please help if you can. I have already rescheduled my tickets twice...

who knows? immigrantconnect.com reported that they heard that some applications were approved in june even when the pd wasn't current in that month. i wouldn't worry about it.

In Dec 2007 my dad got admitted to the hospital for 17 days due to DVT (Deep Venous Thrombosis). Total bill from the hospital was $48,000.00. IMG paid most part of it and I paid approximately $2000.00 as patient resposibility.

Yes, only some progressive companies with progressive thoughts will actually do something. As such, only progressive politicians will do something about.
Rest, they don't care. If they get someone (Citizen, H1b, L1, b1) anything they will get their work done. In big companies the issue is with heirarchy. You superior would love to do something for you because you work hard and get him good name but then managements are not like that. They are selfish. They would like to cut costs and if possible they would love to see your job going overseas ASAP after keeping you as contractor tillwork gets done. These companies will never change. Never rely on such companies.
Mid sized companies with energetic entreprenuers who have progressive ideas and thoughts would actualy fit our cause. They see you as an integral part of the organization and would like to help.
About DL: it is crazy. I made 5 visits to DMV CT to get my out of State DL renewed.
These things must be changed.
