Eb2 will be better most of the time because many will not be eligible or Job position does not need Masters or 5 years of experience. So it will move fast though it may go back on october. So if possible try to port into EB2 will always be a good idea. CIR or Visa capture bill may not be possible atleast for an year or more. EB1 and EB2 are best bet for next 1 to 2 years.
Dream on about porting from Eb3 to EB2. On an average it is taking more 9 months to get labor clearence that too if it is eb3. if you are trying eb2 that is almost a definite audit. We have a case in our company which was stuck in audit (eb2) for more than an year now. our company and attorney are no longer filing eb2 (offcourse it is a different matter than they are no longer filing any green card application because of layoffs). So unless you are working for a desi "con"sultant company not many american companies (almosy none) are filing eb3 green card perm applications leave alone eb3 to eb2 conversions. I am reviving this old thread because it was created by me, and it is highly relevant now. I predicted last month that EB2-I will become "U" soon, and it has happened (almost).
The quick way out of this mess is to ask CIS to move subst labor folks back in the queue. That will ensure that both EB3-I and EB2-I will move forward to July 07. Most of the labor substitution took place in that month itself.
This is an admin fix and does not require any new legislature. This is an idea whose time has come.
The intent of a subst labor was to save the company time and money for obtaining another labor for the same position in case the original beneficiary drops out. Remember, labor was a company petition, not employee petition. The companies still would have wanted it even if it does not retain its original PD.

Come on IVians ..... Is it so difficult to make you adults understand that the thurst we need year would be the biggest...do you want the tech lobbyist to increase only H1B's (remember they have lot of money). Guys we will lost in the crowd if don't prepare ourselves for the forthcoming face offs next year. We are closing in on the traget, but only thing which can make it happen is more members and more money.

-- Grass root & state level efforts work only when there are a lot of grass root workers. For example independence struggle in india worked due to grass root efforts. But please try to understand that things are different here --- by definition, we are immigrants, our numbers are limited in this country.
Simply put, groups working in isolated corners of the country are having no effect on the politicians, because each area has only a few people and the politicians are not seeing the combined effect.
"Grass root efforts" may sound very trendy, but are actually leading us no where............yes we need it......but at the same time IV has to have a strong leadership who can show their strenght by doing phone / lettere campaigns.

Your first post seemed asking only career wise successful folks who have patents/inovations and are affected by retrogression. I did write my story and then reread your first post, then thought to myself: my story is just similar to that Italian lady! The only thing different is she probably would have gotten her green card without much trouble, unlike my process.

My wife is in F-1 status, but I�m afraid to change to F-2 right now and loose the opportunity of transfer the H1 to a new employer... unluckily finding a job has not been an easy task, since I am in Puerto Rico and here the situation is not good.
My last paystub is June 14th, and I was wondering to apply on July 2nd, but because on delays with the medicals I got trapped in the Visa Bulletin fiasco mess.
I've talked with several local lawyers and none of them has given me hopes beyond the F-2 status.
Some friends recommended to file I485, but I don't want to risk for an RFE :(
