    This is the only link that spots to this I have seen this earlier Not sure how reliable this is ? What is the need of any sublabor demand ( per direction of this thread?) if they just retain 140 date ? There would no need in first place for any one to use it .

    Here is what i found on USCIS website Posted after 7/2007.. btw this is quoted in Labor sub case.

    "The petitioner must establish that its ETA 750 job offer to the beneficiary is a realistic one. A petitioner's filing of an ETA 750 labor certification application establishes a priority date for any immigrant petition later filed based on the approved ETA 750. The priority date is the date that Form ETA 750 Application for Alien Employment Certification was accepted for processing by any office within the employment service system of the Department of Labor. See 8 CFR 5 204.5(d)."

    Here is something i found on the web for the interpretation of labor sub cases, the original PD stays with original beneficiary, but when the labor certification is used for another beneficiary then USCIS should allocate the new I-140 filing date as PD, not the original LC date.

    Following link suggest that labor substitution should not grant PDs.

    Can IV bring up this issue with USCIS contacts and see whats their interpretation of this rule?

    You wont belive but the labor sub was a big mess and thanks god both USCIS and DoL realised this rule being abused and scrap it, but i am pretty sure the sub labor filed in July 2007 fiasco is clogging india EB-3 PD and it will remain at that level for next 2-3 yrs.

    Has anyone got an idea of unused visas from EB1 and ROW EB2?

    It just can't be right the EB2 movement for India and China is hardly moving since EB1 is current and EB2 ROW is current since 6-10 months.

    Which category does the unused/overflow visas go?

    None of the lawyers I emailed have an answer (they like this retrogression btw more $).

    USCIS doesn't care if a non citizen asks a question.

    WASHINGTON: Hundreds of Indian high-skilled professionals in the US who have been on a roller coaster ride over the past month in their effort to get the green card will draw attention next week to their frustration -- with white flowers.

    In a unique display of Gandhigiri -- a demonstratively peaceful Gandhian protest popularised in a recent Hindi movie -- scores of Indian H1-B visa holders who feel jilted by the abrupt changes in US immigration rules are planning to deluge US Citizenship and Immigration Services (USCIS) Director Emilio Gonzalez with flowers on July 10.

    Their peaceful venting stems from a June 12 USCIS notification that promised to fast track the green card process for tens of thousands of skilled foreign professionals and their spouses -- only to disappoint later. The announcement led to a stampede in countries such as India and China for obtaining birth certificates and other related documents needed for the process. Applicants spent thousands of dollars to meet the requirements and the deadline.

    But on Monday, USCIS rolled back its notification, turning, according to the lobby group Immigration Voice, "a glimmer of hope into despair."

    The idea of overwhelming the USCIS office in Washington DC with flowers arose from a fervid discussion on the bulletin boards of Immigration Voice where many skilled workers vent their frustration over the long drawn green card process. Although there were some dissenting voices which said such gestures would be wasted, proponents of this form of Gandhigiri said up to 200 people had signed by for the flowery protest.

    According to some estimates from Immigration Voice and its supporters, the Green Card flap affects more than 100,000 skilled workers and their spouses and family in India. Each applicant for the fast tract process announced by USCIS last month is said to have spent upward of $ 2000 to submit documentation.

    Except for the $ 325 filing fees which USCIS has said it will refund, the rest of the money, including towards attorney fees, medical exams, couriers etc is down the drain, several applicants said.

    "I'd guess that with about 100,000 people filing along with at least one secondary applicant each, that's $ 400 million down the drain. That's not chump change," Vikas Chowdhry, an applicant who has been closely tracking the process, told ToI.

    The bonanza for immigration lawyers and physicians who conduct medical fitness tests, who had a busier four weeks than normal, comes on top of millions of dollars of social security tax that the US government collects each year from temporary guest workers (including H1-B visa holders). These guest workers don't get a refund when they return home if they do not qualify or wish not to become permanent US residents.

    The Indian government has been trying in vain to arrive at a 'totalisation agreement' with the US in this regard to refund the money. But Washington has been resisting it because without continuous contribution from new immigrants, the country's social security system would go bust.

    The 'florid' protest aside, AILF, the litigation arm of the American Immigration Lawyers Association, is also considering filing a lawsuit against USCIS for possibly having violated federal regulations and precedents, apart from the personal trauma and stress caused to individuals.

    Dear All,

    The idea behind this thread was to consider the option of a Time Bound Path for he beneift of the existing EB2 / EB3 folks who have filed Labour / I - 140 / 485.

    I think the purpose of this thread is totally lost.

    I am not sure how STEM or F1 or whatever should be a discussion here.

    Anything we start here ends up in an acrimonious debate and many a time becomes very unpleasant and personal.

    What are we all here for? Is it not our idea to to bring some relief to the EB immigrants?

    Once again I request one and all to kindly refrain from unpleasant debates and think of working together for the welfare of the EB2 / EB3 community.

    If we have our objectives clear and work towards a common goal, we sure can achieve success!

    Well, one does not know the exact pre-adjudication policy at the service centers i.e do they re-open a pre-adjudicated file after a certain time period or something in the several database changes that prompts it.

    One thing we need to remember and is certain is that, in the month of June and July 2nd of 2007, just before the fiasco thousands of GC's were issued (much much beyond the capacities of all I-485 service centers). This happened only because of pre-adjudication. I know several who had gotten RFE's in the year before and simply got their GC's quickly in June and July 2nd. (with EB3-I PD 03/04/05 as well !)

    I just received a letter from the person who took my AOS interview

    The letter reads like this,

    The Priority date for your classification is not current at this time. Your case meets the requirements for abeyance until a visa number is available for your priority date.     wow...she screwed us royally..on face she said she is going to approve our petition as it every thing and also PD is CURRENT..Now she sent a letter saying my PD is not current and adding insult to an injury she sent a link to the DOS bulletin which says I am current.

    Only you can Do USCIS..Long live.

    A Great Big Thank You to all of you who have been Contributing to enable IV to organize an event of this proportion.

    My sincere gratitude for the countless hours/days/weeks/months that IV leadership has donated in doing the background work and getting the advocacy days put together. Special thanks to Aman, Himanshu, Pratik, Anu, Jay, Sivkanth, Gopal, Puneet, Kiran, Meenal, Prasad, Bimal, Vikrant, Devang, Ravi, Renji, Ameet & all the DC folk who arranged for out-of-staters to stay in their homes and helped with all the logistics. I got to witness your contributions first-hand. Thank You to your families who supported you and to all the other volunteers working remotely and finally to the ones that I inadvertently left out, a humongous thanks to you too! Kudos to the member from California who attended the event despite having a sick baby at home. Many many attendees have made many many personal sacrifices to come for this event and they are worthy of applause.

    At first, I was hesitant to join because I hadn't been as actively involved in the past months; there was too much personal stuff going on that needed to be dealt with; too much work load, and taking vacation now meant I would have to take unpaid leave when I needed it later. Plus the cost of tickets and getting away from family responsibilities. I thought I could escape with a $ contribution and let someone else do the real work. However, a few phone calls later, I realized how lame all this sounded when people that didn't need to be doing this were working hard for my issues and volunteering for an effort of which I was going to be a beneficiary. It helped that we had a team of members from Texas chapter who had already come forward to go to DC and others were contributing to enable more members to participate.

    Many conference calls were organized by IV leadership right up to the day of the event and many volunteers made hundreds of phone calls to request our members to participate and represent their state and districts. After all, members of congress are working to solve issues that are most affecting their own constituents and having members from their own district coming to DC carries a lot of weight. Many IV members I spoke with had some problem or another and couldn't make it, and then there were few that really wanted to help out in any way they could. In the background, meetings were being sought from both Senate and House representatives, and confirmations were coming in right up to the last minute.

    Situation Room on Sunday:
    Got to the Situation Room in Hyatt on Sunday afternoon. Nervous excitement was in the air. Meeting new faces & reconnecting with old ones brought back memories of September 2007 and the atmosphere of college festivals. Training sessions were already in progress, followed by mock sessions which I thought were a terrific idea. There were printers set up and volunteers were at work printing business cards and IV information materials and arranging them into folders. Another row of tables had been set up for signing in, IV coordinator & state chapter leaders were matching up meetings with team members , reaching out to members to confirm their attendance and new members were pouring in throughout the day and evening. Pictures were being taken and posted on the blog. Past and present USCIS Ombudsman visited us there and supported us and spent time talking to us one on one. There were a couple of people that had joined IV just a few days ago and now participating in Lobby Day. Then there was my DC host who was not going to be able to participate in the meetings, but the energy of the situation room got to him and made him change his decision. And how couldn't it! I stayed there helping out until midnight, but a few folks didn't leave until the wee hours of dawn. I must confess that IV Situation Room is THE most fun thing to do in DC. For those of you who missed it, I hope Congress does nothing and you get another chance when IV plans this again. (just kidding...)

    Monday - Day 1 of Advocacy:
    We met in situation room in the morning. Everyone picked up their schedules for the day and were off to a day of true grass-roots work of educating Congressional staff of our issues and proposing solutions. The most important part was telling our own stories of how the process is affecting our lives and driving talent out of the country. The staff members were very polite and listened carefully to our points. Not one of them argued against any of our issues. The support was there, although we did hear things about political climate causing the delay in action on part of Congress. I was done with meetings at 4 pm on Monday and we walked across the Capitol and onto New Jersey Avenue enjoying the perfect DC weather on our way back to the Situation Room. Folders had to be prepared for the next day and schedules created as well, since there were some last minute meetings coming in & some members not able to make it for the next day. We also had to pack and move and set up the new room upstairs since we switched rooms in the Hyatt. Once again, we got out of there at 3.30 am, and had to get back in by 9am.

    Tuesday - Day 2 of Advocacy
    Another full day of meetings was in store for everyone. We had fewer members on Tuesday since a lot of them had gone back on Monday and a lot of members did at least a few meetings by themselves. By this time we were all experts at the message we needed to deliver. Once again the response was similar. Some of the offices gave us leads into other representatives that might be able to champion the issue. Some of them were supportive of administrative fixes that could be done while Congress contemplates on larger fixes. Tuesday was the first time I had meetings on both the House and Senate side and we walked through the Capitol to get to the other side. There is a little mini train you can ride and the building has impressive murals and architecture. But we had very little time to appreciate those in detail. I had the opportunity to meet one Senator himself and it was a whole new feeling being face-to-face and talking to someone that shapes American future laws everyday and is directly going to vote on my issue. This is what democracy was all about, and IV was the enabler providing me the opportunity to be heard on the Hill.


    Tuesday - Congressional Reception
    This was held in the Capitol itself, we had leading lawyers attend as well as Ombudsman and Congressional staff and lobbyists. There was some nice food to be enjoyed by all, informal discussions, humor and brainstorming for the future. After the 2 hour reception many had flights to catch and rest of us went back to wrap up in the Situation room and brainstorm for the future.

    At the end of it all, I was a little sad to leave all the excitement and return to "normal" life. But there is tons of work to be done in local chapters and those of us who have been to DC know how important it is to go and seek out the members from each and every constituency from our state, get members to come forward and talk to the media, and finally raise funds so that we can continue lobbying Congress to fix this problem.

    Thank You IV for providing us with this platform to get our voices heard where it matters the most. Go IV!

    1) We got a spike in new membership and funds
    2) We now have atleast 2 more NATIONAL publications who have taken notice of our activities and are more sympathetic to our causes. They feel we have a compelling story and they are interested in publishing about our plight...

    In fact two IV members are being interviewed today by a leading publication.

    and the most important
    3) We got additional material to provide to senators and their staff...this really helps as we do not have to establish ourselves....our stories along with newspaper articles help make our case much stronger....

    When we initially started meeting senators, their staff would ask QGA 'Immigration Voice, who or what is that?'

    Lately when we go to meet them, most of the staff have already visited our sites multiple times, know about us because of phone calls and faxes by members and ofcourse the articles that have been published....on top of this when we provide stories of members from their constituency, 50% of our work is already achieved....the liason team and QGA take over from there.

    So to answer your question, yes it helped a lot

    So, basically if I get a new I-94, am I in status again? Someone mentioned that you should be in status since your last arrival to the US. That was in 2004. So, i was under teh impression that I had to leave the country and return and things would be OK.

    If you know, can you PM me any lawyer who you can help in this matter?

    Yes when you leave the country you are in status again! for i-485 AOS, USCIS will look at your status since your LAST entry into the country

Including the president, right? what does that mean? it clearly means that they are against deporting all those ilegal immigrants who are present here. some sort of amnesty is the only solution accepted by the majority. Now when this will become a law, nobody knows but atleast we have had several weeks of delibrations last year and sooner or later they will get back to it. If it were not for the economic woes and the wars they would be considering the health care and immigration simultaneously.

    Thousand if not millions of us are affected by DOS's reversal or the visa bulletin, and it would be quite a protest even if 20% of us joined together and raised our voice against this ill-fated system.


    Well said. Just think of this flower drive as a way to display our collective might to the media. What really shocks me is that most of us are tech savvy and yet we don't even see too many blog posts on this issue by the community of skilled, legal non-immigrants.

    We need to be more vocal, and sending flowers is just another way of expressing our thoughts.

    i bet it was pretty interesting to negotiate directly with the WH and DHS. kudos. i guess we now have this to build on for future... perhaps one of our next goals will be to expidite namechecks for all these new 485 applicants? ;)

    1) Was there an LUD update on ur I-140 (Last Update Date on the USCIS.gov website)
    2) What Service center did you guys file in?
    3) Do your recept numbers start from LIN or SRC?

    1)No LUD for me.
    2)Filed in Nebraska,on July 02 at 11am.Signed by C Uhrmacher,
    3)Receipt numbers recd for self and spouse for I485.I765,I131.Receipt dated 08/08/2007.All numbers start with LIN.
    When I check my status online it shows a LUD on 8/12/2007 which is a sunday.
