Yes you can -when you were eligible for the EB2 filing at the time of filing for EB3!
Why would someone do that u ask? Please call my employer and ask him this question. The answer is - so that you are stuck with him for few more years.
I am in the same boat. My employer decided to file my case under EB3. For that, even the job position was in such a way that required only EB3. I had 7 years experience at that time. So it could have been EB2. That is fine, I am not sad about it.
My question is, since the original position had requirements that met EB3 and not EB2, how can you now justify moving to EB2 within the same company and for the same position?

Hi I am not exactly in similar situation but still relevant in the context. I have labor and I-140 cleared but my wife is working in India and she may not be able to come back in order to file I-485 within a month or two. If I file I-485 for myself can I file for her later? What will be the consequences and what are the timelines? I have a valid H1 Extension till May 2010. Can she still get this extension stamped and return on H4 visa?

I am not an expert but I have a hunch that EB2 India will progress to Jun 1 2006.
Based on your calculations , Experts, please let us know what to expect, if 12000 GC are released for EB2. Where will the cutoff come and stop..

I am surprised to see this thread active this long. Earlier I have with help of Saralayar and other members have bring this point to attention. But at that time no one was supporting Idea.
I see increasing support for the Idea as GC journey become longer and longer.
Earlier I have pointed following points that I want to bring to remind if we want to get real support for this idea of early CITIZENSHIP AFTER GREEN CARD
(1) I-140 and I-485 must be approved.
(@) Time should be considered only after getting GC
(3) For getting closer for political support our proposal should be close to Existing laws for FAMILY BASED and MARRIAGE BASED CITIZENSHIPS
So we should argur that if YOU HAVE MASTER AND ABOVE IN STEM FILEDS YOu can get CITIZEN SHIP 5 yrs from date of Approval of I-140 ( which make it closer to fmaily based) and THREE YEARS from Date of Approval of I-485 (closer to marriage based citizens). You can get earlier of two . But when you get Citizenship your I-485 must be approved for ATLEAST 1 year.
The above requirements can get closer to Marriage and family based and also help 90% of IV members.
Adding the clause for the EDUCATIONAL THING might be able to get more political support also

My immigration doctor told me that if i had chickenpox in childhood i do not need the varicella vaccine? Which i did at age 5. Please, let me know if anyone else was told the same , i will be going back to him on Wednesday for the physical exam. I don't want to get a RFE on that.
You need proof that you had chicken pox- a relevant letter or prescription issued at that time. Your Doctor can also order a test to find out the antibodies- the presence of which proves that you had chicken pox, but my Doctor told that it is expensive and easiest thing is to just take a shot. (This is what we did for my Sons school admission here, same provision is applicable for immigration I guess)

I have news for you (and the certitude with which you make your claims here are laughable). Computer science graduation rates in US went up this year by 6-8%, because the visa caps since 2003 remained at 65000 instead of 195000 creating some demand here. I personally know kids who wanted to go to Computer science, but went for other areas like health care because of the lack of offshoring/H1 etc. If the crooked Indian offshorers and fly-by-night operators are not driving down the wages, more americans will go to computer science, as they would go for a career as MD or Pharmacist or lawyer (almost all those careers need at least 6-8 years of college). They also know that professional associations like AMA or APhA wouldn't allow importing foreign workers by corporations/hospitals on a scale that H1-bs are imported in IT area

Contrary to what you claim, people are aware of H1s and offshoring(may be so much on the exploitation of L1) as they talk to friends and family and guidance counselors at school. Most of the IT jobs were Indian H1-bs are employed doesn't even need computer science or engineering degree. Some of the best architects I have seen in IT didn't have a computer science major. A green-horn from TCS/INFY with a computer science degree and pretending to be an architect doesn't mean he is the best IT professional available in the market.
American college kids spend most of their time partying and sex. They do not study. Only a very very few really study. Others just get by because professors are under pressure to pass them. If professors fail them, then no student will take their course or give bad rating that will affect their Tenure track. The education system is just pathetic and thus kids prefer to study arts and commerce. It is because they cannot fathom tough calculus or trigonometry. The pre-college years are spent in Prom nights and losing virginity. Thus these people fail to compete at global level. Only very few are good and they go to good universities. On the other hand international students come after lot of hard work and tough competitive education system. They are well trained to learn even in meagre resources and compete with others. This is the reason international students and immigrants do well in this country and innovate.
So stop calling your American people as best and brightest. Most of you who come here on this site and live on anti-immigrant sites are middle aged people who cannot get a job anywhere. You guys are just too lazy to study new technologies that is ever changing. You are more interested in having beers and watching football. Go and study and upgrade yourself rather than whining. Dude, then why are we blaming people like punjabi.........it is not his fault that the supply was abundant and demand receded..........I would still blame the banking system for the housing failure.......they landed out money which they knew would stop coming back at one point in time........and again, it's not that he cannot afford his monthly payments...........he just cannot sell his asset - to me that is a problem on the part of the lender and not the borrower. No wonder banks are re-adjusting the home loan amounts (to a much lower value than originally specified in the agreement) for people who cannot pay the normal mortgage (due to whatever reasons). Go and teach the same lesson to these greedy banks and lending institutions.
Again, I am not saying that foreclsosing (escapism) is a good route to take, as there are other ways to keep the paying the mortgage without hurting your mobility but at the same time it is not prudent to blame it entirely on the borrower - lending institutions are responsible for major part of this mess.

This prediction business is done just to derive satisfaction of doing something towards a goal. This is especially true when one can do very little to get to that goal and it all depends on many other factors. Yet predicting the PD is not a bad endeavor by itself. That being said, predicting PD is not an easy math without knowing the PD of the last pending application in a category with the CIS and many other numbers. If I am right, I believe even the DoS and CIS have trouble with it.
This what one Mr. Oppenheim says, "This situation will allow me to advance the India EB-2 cut-off date for May". That is it. So the PD will move in May unlike in the past when it moved in June/July/August in a FY. My understanding at this point is that there is no way to predict what will happen to the PD in May VB. THere are just not enough precise numbers available to do that. The May VB may come on 8th April and the numbers that are accounted for in it might be as close as 1st April'11. We do not have that number with us.

Yes, They assured me that the plan is for unlimited...also covers all the networks (Initiall y some of them thought that it's only applicable for certain networks)....there is no restrictions at all...any ways I will re confirm with them.....
The only problem with them are taxes, there are other VOIP phones in the market that they are charging just 3-4 dollars as taxes, whereas vonage is charging more than 8 dollars which is killing part.....

On another front, if this actually does happen, I will be the first person to sue USCIS for all the expenses, lost time and headaches that I incurred in preparing the 485 application...I think USCIS can't get away without reimbursing everyone for all of the above...

The law unambiguously states that for employment based categories - EB1 spillover should first go to EB2 and whatever is not required by both EB1 and EB2 will spillover to EB3. If the USCIS has been doing something different previously they were actually not following the letter of the law.
Here are the relevant sections of the INA which unambiguosly states the above.
Here is what Section 203 of the Immigration and Nationality Act states -
EB1 -
(1) Priority workers. - Visas shall first be made available in a number not to exceed 28.6 percent of such worldwide level, plus any visas not required for the classes specified in paragraphs (4) and (5),...............

Some ideas are good. In order to implement them, we need support from members. Pls volunteer and take up the ideas to lead them. For example I have mentioned about poster and banner campaign. If each one of us, prints them and post them in various places, we can get good publicity.
We have to make do with such low cost volunteer work. Someone pointed out that we should contact newspapers and get articles published. Wish it was so easy. We have written tons of mails but that alone does not work. You need to issue press releases and publish them online. Publishing them each online costs a couple hundred dollars by publishing services who distribute, and there is no guarantee it will be picked up. Thus you need a focussed campaign for it. There are services where you can contact reporters and media on a specific topic and send them email, press release directly. If they are already writing article you can know the deadline. If you have an idea, you can pitch a story idea to the reporter directly. A good service I know costs 5K for non profits for one year. If you need access to International reporters database add 2k to it. All this is possible only if we have these kinds of resources. When we can hardly get contributions of 5k in 4 months after collecting $5 each, it is tough to plan a big media campaign. The reason why other big organizations and big anti immigrant orgs can get so much publicity is that they probably can spend their huge resources on such services. They can also afford a full time staff. We do not have all that and run IV along with our full time day time jobs. So the first thing we need to do before we run any campaign is to get more members and more contributions and monthly signups. Without that ideas may only remain on the forums.

Your input and suggestions are excellent. IV (Immigration Voice) is working on the exact things you pointed very clearly. We will together make the difference with the upcoming bill. IV is today 5 days old. I think IV has made very good progress in last 5 days given the fact that most people are in holidaying mood and not paying much attention. But there is a long way to go. I would urge you to please actively participate in discussions and other activities to spread the word around to your friends and family with the request that they as well send the same message to their friends. You could help by posting the flyer in the attached file in places like Indian/Chinese/Philipino stores/restaurants/other meeting places and request your friends to do the same. This is the first step towards creating awareness to bring everybody facing this problem on common platform.
I agree 100% that misinformation, stereotyping, unorganized campaign with hastily typed faxes/messages by individuals hurt us in S1932. There were a lot of motivated individuals but most of us were not unable to create a concrete strategy to make the dent in S1932 as there was not platform to join hands. We are all on H1s/EADs and facing severe problems due to retrogression. We are all learning as this campaign is picking up steam. The idea is to be more organized. We have received personal emails and phone calls from lot of motivated individuals spread all around the county. All of these individuals want to see solution to retrogression issue. We need more individuals to come forward to actively participate for this cause.
Please continue to provide your input and contribution for this cause. Please invite more individuals to participate on this forum. We are a very young organization and maybe after 6 months, once all this is over for good, we will look back and thank individuals like yourself who�s encouraging words and support are so important for the success of this cause.

Implement the existing interim rule to allow issuance of multi-year Employment Authorization Documents (EAD) and Advance Parole.
According to Mr. Aytes, USCIS is already working on it. Why to mention it in the letter?
That will rather give anti-skill-immigration crying babies one more thing to cry about.
Now what? Under the new filing fee schedule which took effect after July 29, 2007, issuance of EAD and Advance Parole for the post August 27, 2007 is "free, free, free" for the I-485 filers. Allegedly, the cost is incorporated in the I-485 filing fee of $1,020. The new regulation uses the term of "fee waiver" for EAD and Advance Parole for these I-485 filers. Now, you guessed it! Lo and Behold, the business calculation on EAD and Advance Parole has reversed. The DHS will lose a huge money by issuing single-year EAD and a separate Advance Prole document on a yearly basis over and over since they are free and they will have to keep producing it at no charge every year, which creates a huge workloads consuming its huge human resources and other production costs. This is particularly unacceptable to the agency under the predicted State Department Visa Bulletin for FY 2008 and in the future. Now, from the business standpoint, the DHS may make a huge money by issuing a multi-year EAD which will also function as a travel document. Ahah! No wonder why they are finally coming forward revealing their hidden agenda behind the new fee rule-making and EAD/Advance Parole reform business. It is OK - whoever wanted to go this length. FYI, 'have been a member of IV and a donor since inception. Is anyone from the core who thinks this idea is insane?
Like-minded folks - let us work on it
How about having a list of action items and getting an opinion from the IV core on them?
Who is thinking your idea is bad or your intentions.. dont worry about these reds. I got 7 recently, but people who see your point will give u a green and that will go off.. Dont spoil your mind.. and give us more ideas.. how do I give you a green.. can someone show me..
