    I haven't yet used the SBI-NY remittance service (registered only last week), but I do not need to open account with them. Instead, I can send money home (only to an existing SBI India account) directly from my credit card, using a specific remittance form. I find this arrangement convenient, but mailing the form for each such transaction adds to delay. I find your suggestion better instead, and also probably quicker.

    Does someone have an experience of application process, so that i send in the right papers, before leaving here. i mean the set of documents to send to DOL, so that i do not miss out on something important which could nail him to the maximum

    Do you have a copy of the H1B application?
    It should show a lot of details about the employer and also as to who prepared the forms(attorney info if there is one)

    As i said if the company itself has done the work themselves with a full time attorney...then the company is fully liable...if the company has hired outside attorney...the company is still liable...but the outside attorney would also be liable for building fake cases.

    There is also a law that if the H1B employer has terminated your services before the estimated time your service was required then the employer has to pay you the transportation costs for your return home.

    I have been doing that for quite some time. I dont know the success rate yet. My wife is part of a group which organizes Potlucks every other week. I take that opportunity to educate people about IV and the need to join it.

    Regarding conributions, I know it is probably going to meet with some resistance from other members, but we can organize a membership drive week. Any current member signing up most members during that week can be rewarded in some way. The reward need not me monetary, because people are not here for money. So, the reward can be some sort of memento.

    As far as contributions are concerned, there are many ways to raise money in this country like Raffles, Fund raising by selling some products. (See how Boys and Girls Scouts sells cookies.) and so on.

    None of these is impossible. Remember, there is no such thing called IMPOSSIBLE, because the word itself says, I'MPOSSIBLE.

    The core membership may be modest and may not want to speak out much on this issue. It becomes our prerogative to drive this.

    Lets do this. Zooom do you mind opening a separate thread, "Reimburse past expenses to Aman & other IV Core members" or something like that. Please post a message asking people to "pledge" an amount towards that effort. Can you two drive this effort. I am also available for assistance.

    We will update members who pledge how to finalize their pledge by any of the following methods based on subsequent expert advice:
    1) Should they contribute to IV directly
    2) Send a personal check to Aman.
    3) Other method like IV reimbursing Aman and others from the common donation corpus.

    finally, something good by DOL for us.
    Yes it is good that they are changing the rules despite opposition from lawyer association. Lets also hope that it gets implemented soon since there will be some opposition until it comes into effect. A lot has been changing in these agencies. Decoupling of H1 and H4 time, now Labor sustitution, premium processing, classification of service centers Etc. (we dont have a long list yet!) All this is also due to the phone calls people have made, letters people have written, articles media has published about inefficiencies and broken system, lawmakers people have met and aired their problems. Lets hope the wheels of change start moving fast enough for us.

    Shouldn't they release some memo or something before making a drastic change like this???

    They should...

    What is confusing is that in the notice of intent to deny; uscis officer stated that person may be eligible for ac21 and to give a job letter.

    The only thing I can think of is that there may have been something wrong with the I-140 (ie., too many cases file by the 140 company and company revoked it in response to an ability to pay query, etc.).

    This particular company is pretty large staffing company. i do not have any interaction with them but from what I know; they have been cancelling a lot of people's h-1b's and telling them to find other employers to transfer to. Don't know if there is a story within a story.

    By doing what you are suggesting

    a) you take numbers away from EB-3 ROW and hurt them
    b) you don't do any benefit whatsoever to EB-3 India/China
    c) you only benefit EB-2 India/China (at the expense of EB-3 ROW)

    So, you make no difference whatsoever to huge number of EB-applicants (b), and you benefit (c) at the expense of (a).

    I hope you see that this is not a good solution for the majority of EB-applicants. With this kind of cannibalization, the only people who have any incentive to stay with IV would be EB-2 India/China.

    We have to work to increase the size of the pie here, and not engage in a zero sum game.


    It says "not required by other classes". In this case it is required but could not be applied to EB2 due to per country numerical limits. Therefore it should go to unused pool of visas followed by AC21. Also why will USCIS prefer EB3 instead of EB2 people? It does not make sense.

    As far as suing the govt is concerned we all know what happened to doctors in the UK.. so this is will be a futile exercise.

    Skilled, Legal Immigrants To March In A Protest Rally In Silicon Valley

    July 12, 2007

    What

    Hundreds of legal, highly-skilled workers, who feel disappointed by the recent "flip-flop" enacted by the Department of State (DoS) and the United States Citizenship and Immigration Service (USCIS), with regards to eliminating the Green-Card processing delays, plan to stage a peaceful rally to bring attention to their issues and to demand a fair and equitable treatment.

    Where

    The New City Hall 200 E Santa Clara St San Jose, CA 95113

    When

    July 14th, 2007.

    Planned Route

    11:00 AM: Meet at San Jose City Hall at 200 E Santa Clara St.
    11:30 AM: Go to the square in front of Dr. Martin Luther King, Jr. Library (150 E San Fernando St).
    12:30 PM: Walk towards 635 N 1st St through S 4th St, E San Carlos St, Market Street and N 1st Street.
    1:15 PM: Arrive at 635 N 1st St and stay till 2:00 PM
    2:30 PM: back to City Hall

    Why

    Silicon Valley is the world’s most advanced crucible of innovation, an example that countries all over the world have tried to emulate. The success of Silicon Valley as a global hub of innovation has a lot to do with it being the world’s foremost melting pot of highly skilled immigrants. In San Jose, the heart of Silicon Valley, these highly skilled, legal immigrants who want to continue that tradition of innovation by becoming permanent residents of this country will stage a peaceful protest rally to bring awareness and attention to their issues.

    The people gathered at this peaceful walk are already huge contributors to the innovation edge of the US but their potential is still not fully tapped as it is still being hindered by unreasonable delays and bottlenecks in the process of gaining permanent residency (green-card).

    With this effort, the skilled, legal immigrant community hopes to create awareness about their predicament and express their anguish and frustration at the reversal and the lack of action from the Government. These are the highly skilled workers who have been driving the innovation in the US for many decades and have been living in this country legally and yet, they feel that their issues, concerns and contributions to the economy have largely gone unnoticed. According to exhaustive research done by Vivek Wadhwa, executive-in-residence at Duke University, if highly skilled immigrants in the U.S. don't have a chance to stay here permanently, would-be entrepreneurs take their skills back to their home countries—where they compete with U.S. companies instead of founding them.

    There are 140,000 Green cards allocated for highly-skilled workers and their dependents in a fiscal year (unused visas may not be rolled over to the next year). However, due to over-subscription, thousands of highly-skilled workers, including engineers, scientists, MBAs and health care professionals have been waiting patiently for years in order to be eligible to apply for their Green cards.

    Now, these highly-skilled professionals have decided to call attention to the "broken" immigration system in the U.S. for legal immigrants. Earlier this week – the community received widespread attention when hundreds of them sent flowers to the USCIS Director, Emilio Gonzalez. With the San Jose rally, the community of skilled, legal immigrants wants to put focus on people who have abided by the law, played by the rules and ask for a fair treatment and attention to their issues.

    lots of EB3 qualify for EB-2 after such a long wait and in the first case they were put into eb3 although they could have gone to eb2...

    I cant believe that EB-3 is at 2001 when we are getting to 2009..its really a shame on the system

    if this is how they treat people the entire h1b needs to be scrapped or people spend thier decades in slavery working this unpredictable system thinking that they will get in next few months..its like chasing a mirage in the desert....

    So we have an amendment that deals with Immigration Voice's goals - http://immigrationvoice.org/forum/showthread.php?t=521. Now what?

    The Brownback amendment that benefits all of us in one way or other is on the table for the immigration bill(Specter’s, Frist’s whichever). Thanks to Senator Brownback, his staff, our counsel QGA, our friends in AZ and PA(not in core IV team) who played a key role in convincing the staff and Senator about our problems and solutions and MOST IMPORTANTLY - YOU - the volunteers and members who supported this operation financially and morally.

    Friends, the game has just begun. The fun part, the challenging part comes now. Those who are familiar with S 1932 know that the real deal is the house-senate conference committee IF the immigration bill gets any traction in Senate post recess. In a rare event that immigration bill is ignored this year, we need to focus on getting these amendments in other bills like PACE act, TALENT bill etc. Immigration Voice’s morale is like DURACELL – IT NEVER DIES. NEVER NEVER NEVER.

    So , before we open that Champagne bottle let's make sure that we are ready for the next stages in this effort:

    1. Getting majority of Senators to vote "Yes" on our amendment.
    2. Getting the opposing amendments to defeat the good stuff out of the senate bill.
    3. Protecting this amendment in the House-Senate Conference Committee.
    4. Defeating the harmful provisions that may be injected by more creative minds in the House during House-Senate Conf.
    5. Continued efforts to find another bill for our provisions if the immigration bill fails. (Unlikely because of millions of undocumented workers holding rallies. Something WILL HAPPEN).

    All this is going to take lobbying, grass-roots efforts and a lot of work.

    So now, we regroup. We gain strength. Lend a hand to the fence-sitters to join us. Convince the NAYSAYERS that this works. And we raise more funds.

    Today, IV Core group sincerely requests members to whole-heartedly contribute just like you contributed before. Let's give this movement a momentum so strong and powerful that its invincible. Let us get all hands on deck.

    THE GOAL:

    The goal is to raise another 75,000 in 25 days. That will bring the total contributions to around 150,000 by the first of May.

    We have always asked people to contribute whole-heartedly as this is a non-profit operation, no core member or volunteer makes any money on this and we are accountable to IRS due to our non-profit tax status. We have always done EVERYTHING LEGALLY and will continue to do things legally. If in doubt, please visit the menu "Lobbying and the Law" on the homepage. Remember, the core members want their greencards too and they wouldnt be doing things that are illegal and risk their own greencard applications.

    Conribute and be a part of most successful organized effort ever done by a bunch of high-skills legal immigrants. Be a part of movement that will make you proud for the rest of your life. Something to tell your children about. A few hundred dollars saved by not contributing will not make you happier. I can guarantee you that. The money I contributed to IV has been the most well-spent amount in 6 years of my time in US. And dont ever rely on "Others will do it and I can evade this as one person wont make difference" will NEVER WORK. It never does. If you think that there are friends that are affected by retrogression then call them, show them the amendment and tell them to stand up and support this.

    1. Benificieries of tax treaties among H-1B applicants are very small in number. They are from mostly European countries.

    Based on this small number of H-1B immigrants who do not pay Social security, Zazona report generalizes that entire H-1B immigrants do not pay taxes. This is called "Hasty generalization" - a common propaganda weapon employed by unethical writers to confuse their readers.

    2. Even the H-1B immigrants who do not pay Social security taxes, however small their number may be, have a right to utilize this feature provided by their home country to safeguard their hard-earned money. They should not be blamed, ridiculed, villified for taking care of themselves in the retirement.

    Zazona report never talks about Americans employed in Eurpoe utilizing similar treaties to their advantage. That is the other side of the story.

    If you read NumbersUSA reports also, you will find the same theme. The writer willfully obscures the fact and tries to sell his/her belief as a fact to the readers. I sent them e-mails to point out the inaccuracies, but they do not care and they are bent on selling these fallacies to public. No wonder the mainstream media does not accept their versions.

    LOL, I know. I really regret that I wasn't on these forums years ago, I wouldn't have done so many mistakes. I was thinking "what all these dudes on these forums know? I got a big lawyer with tie and bunch of certificates as best of the best of the best." The life taught me totally opposite.
